These Terms of Service ("Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you (hereinafter referred to as "User," "you," "your," "Member," or "Subscriber") and STARFORGE, operated through the website located at https://www.StarForgeKits.com (hereinafter referred to as "STARFORGE," "Company," "we," "us," or "our"), governing your access to and use of the StarForgeKits.com website, including all content, features, functionality, services, applications, and digital properties offered through or in connection therewith (collectively, the "Services"). Please read these Terms carefully before accessing or using the Services. By accessing, browsing, registering for, subscribing to, downloading from, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must immediately discontinue all use of the Services.

1. Acceptance of Terms

1.1. Agreement to Terms. By accessing or using the Services in any manner, including but not limited to visiting or browsing the website, registering for an account, subscribing to a membership tier, downloading files, or contributing content, you affirm that you are of legal age to enter into this Agreement, or if you are not, that you have obtained parental or guardian consent to enter into this Agreement and your parent or guardian consents to these Terms on your behalf. You further affirm that you have the legal capacity and authority to enter into a binding agreement, and that your use of the Services will comply with all applicable laws, regulations, and ordinances.

1.2. Modifications to Terms. STARFORGE reserves the right, in its sole and absolute discretion, to modify, amend, supplement, or replace these Terms at any time, for any reason, with or without prior notice. Any modifications shall be effective immediately upon posting of the revised Terms on the Services. Your continued access to or use of the Services following the posting of any modifications constitutes your binding acceptance of such modifications. It is your sole responsibility to review these Terms periodically for changes. If you do not agree to any modification of these Terms, your sole and exclusive remedy is to discontinue use of the Services.

1.3. Additional Terms. Certain features, services, or promotions made available through the Services may be subject to additional terms, conditions, policies, or guidelines ("Additional Terms"). In the event of a conflict between these Terms and any Additional Terms, the Additional Terms shall govern with respect to the specific feature, service, or promotion to which they apply, unless the Additional Terms expressly state otherwise.

2. Definitions and Interpretation

2.1. Definitions. For purposes of these Terms, the following definitions shall apply unless the context clearly requires otherwise: "Content" means all text, graphics, images, photographs, illustrations, designs, logos, trademarks, trade dress, icons, audio, video, software, code, data, 3D model files (including but not limited to STL, OBJ, and other file formats), documentation, and any other materials or information available on or through the Services, whether created by STARFORGE, Users, or third parties. "User Content" means any Content that Users submit, upload, post, transmit, or otherwise make available through the Services, including but not limited to comments, feedback, reviews, messages, and communications. "STARFORGE Content" means all Content that is owned by, created by, licensed to, or otherwise provided by STARFORGE, including but not limited to all 3D model files, designs, artwork, graphics, website design, text, and software. "Membership" means a subscription to one of the paid membership tiers offered by STARFORGE through third-party subscription platforms, specifically Patreon, Inc. "Commercial License" means the limited license granted to qualifying Members to sell physical prints derived from STARFORGE Content, subject to the terms and conditions set forth herein.

2.2. Interpretation. In these Terms: (a) headings and subheadings are for convenience of reference only and shall not affect the interpretation or construction of any provision; (b) words importing the singular include the plural and vice versa; (c) words importing a gender include all genders; (d) references to "including," "include," or "includes" shall be deemed to be followed by the phrase "without limitation" or "but not limited to"; (e) references to any statute, regulation, or law include any amendment, modification, supplement, re-enactment, or successor thereto; (f) references to "days" mean calendar days unless otherwise specified; and (g) references to "dollars" or "$" mean United States dollars.

3. Membership Tiers and Access Rights

3.1. Overview of Membership Tiers. STARFORGE offers multiple membership tiers, each with different access rights, privileges, limitations, and licensing terms. Membership subscriptions are processed and managed through Patreon, Inc., a third-party subscription platform. By subscribing to any membership tier, you agree to Patreon's terms of service and privacy policy in addition to these Terms. The current membership tiers, as of the date of these Terms, are described below; however, STARFORGE reserves the right to modify, add, remove, or restructure membership tiers at any time, in its sole discretion.

3.2. Wanderer Tier (Free Membership). The Wanderer tier is a complimentary membership level available through Patreon at no monetary cost. Wanderer members receive: (a) access to download 3D model files (STL format and other available formats) from the STARFORGE library, subject to daily download limitations as determined and enforced by STARFORGE in its sole discretion; (b) the ability to browse, view, and interact with all publicly accessible content on the Services; and (c) the ability to save favorites and maintain a personal stash using browser-based storage. Wanderer members are expressly prohibited from: (i) selling, offering for sale, or otherwise commercially exploiting physical prints or reproductions created from STARFORGE Content; (ii) redistributing, sharing, uploading, or otherwise making available STARFORGE Content in digital form to any third party; and (iii) circumventing, bypassing, or otherwise evading any download limitations, access controls, or other technical restrictions implemented by STARFORGE.

3.3. Merchant Tier (Paid Membership - $10/month). The Merchant tier is a paid subscription membership available through Patreon at a monthly subscription fee of ten United States dollars ($10.00 USD), or such other amount as may be specified by STARFORGE from time to time. Merchant members receive: (a) unlimited access to download 3D model files from the STARFORGE library, without daily download limitations; (b) a Commercial License, as defined herein, granting the right to sell physical prints and reproductions created from STARFORGE Content, subject to the terms and conditions of Section 4; and (c) all benefits and privileges available to Wanderer tier members. The Commercial License granted to Merchant members is contingent upon and coterminous with the Member's active, paid subscription status. Upon cancellation, termination, lapse, or expiration of the Merchant subscription for any reason, the Commercial License shall immediately and automatically terminate, and the former Member shall immediately cease all commercial activities involving STARFORGE Content.

3.4. Starforger Tier (Paid Membership - $20/month). The Starforger tier is a premium paid subscription membership available through Patreon at a monthly subscription fee of twenty United States dollars ($20.00 USD), or such other amount as may be specified by STARFORGE from time to time. Starforger members receive: (a) all benefits and privileges available to Merchant tier members, including the Commercial License; (b) priority access to new releases, exclusive content, and beta features when available; and (c) access to design tools for creating new STL files, building blocks, and maps when such features become available on the Services. The specific features and tools available to Starforger members may vary and are subject to development timelines, technical feasibility, and STARFORGE's sole discretion.

3.5. Subscription Management. All subscription payments, renewals, cancellations, and billing disputes are processed and managed through Patreon in accordance with Patreon's terms of service. STARFORGE does not directly process payment transactions or store payment card information. To modify, cancel, or manage your subscription, you must do so through your Patreon account. STARFORGE is not responsible for any errors, delays, or issues arising from Patreon's payment processing or subscription management systems.

4. Commercial License Terms and Conditions

4.1. Grant of Commercial License. Subject to the terms and conditions of this Agreement and contingent upon maintaining an active, paid Merchant or Starforger tier subscription, STARFORGE hereby grants to qualifying Members a limited, non-exclusive, non-transferable, revocable license (the "Commercial License") to create, manufacture, produce, and sell physical prints, reproductions, and tangible objects derived from or incorporating STARFORGE Content (collectively, "Physical Products"). This Commercial License permits the commercial sale of Physical Products through any sales channel, platform, marketplace, or venue, whether online or offline, including but not limited to personal websites, e-commerce platforms (such as Etsy, eBay, Amazon, and similar marketplaces), craft fairs, conventions, and retail establishments.

4.2. Scope and Limitations. The Commercial License granted herein is subject to the following limitations, restrictions, and conditions: (a) the Commercial License applies exclusively to the sale of Physical Products—tangible, physical objects that have been manufactured, printed, or otherwise produced from STARFORGE Content; (b) the Commercial License does not authorize, and expressly prohibits, the sale, distribution, licensing, sublicensing, transfer, or other disposition of STARFORGE Content in digital form, including but not limited to STL files, OBJ files, source files, or any other digital representations of STARFORGE Content, whether in original, modified, derivative, or any other form; (c) the Commercial License does not authorize the sublicensing, assignment, or transfer of any rights to third parties; (d) the Commercial License does not authorize the use of STARFORGE trademarks, trade names, logos, or other brand identifiers in a manner that suggests endorsement, sponsorship, or affiliation with STARFORGE, unless expressly authorized in writing; and (e) the Commercial License is personal to the subscribing Member and may not be shared with, used by, or transferred to any other person, entity, or business.

4.3. Modification of Files. Members are permitted to modify, adapt, scale, cut, combine, remix, or otherwise alter STARFORGE Content for their personal use or for the purpose of creating Physical Products for sale under the Commercial License. However, such modifications do not create any ownership rights in the underlying STARFORGE Content, and the restrictions on digital distribution apply equally to modified, derivative, or adapted versions of STARFORGE Content. Under no circumstances may modified, derivative, or adapted versions of STARFORGE Content be distributed, shared, sold, or otherwise made available in digital form.

4.4. Termination of Commercial License. The Commercial License shall automatically and immediately terminate, without notice or further action, upon: (a) cancellation, termination, or expiration of the Member's Merchant or Starforger tier subscription; (b) failure to pay subscription fees when due, resulting in lapse of membership; (c) breach of any term or condition of this Agreement; (d) termination of the Member's account for any reason; or (e) termination of the Services. Upon termination of the Commercial License, the former Member shall immediately cease all commercial activities involving STARFORGE Content, including the sale of any remaining inventory of Physical Products. STARFORGE reserves the right, in its sole discretion, to grant reasonable wind-down periods for existing inventory in cases of non-fault termination.

4.5. No Retroactive Rights. Termination of the Commercial License does not create retroactive liability for Physical Products lawfully sold during the period when the Commercial License was in effect. However, any Physical Products sold after termination of the Commercial License shall constitute a breach of this Agreement and infringement of STARFORGE's intellectual property rights.

5. Prohibited Conduct and Restrictions

5.1. General Prohibitions. In connection with your access to and use of the Services, you agree that you shall not, directly or indirectly, and shall not authorize, permit, enable, or assist any third party to: (a) redistribute, share, upload, publish, post, transmit, stream, broadcast, or otherwise make available any STARFORGE Content in digital form to any third party, through any medium, channel, platform, or method, whether for commercial or non-commercial purposes; (b) sell, license, sublicense, rent, lease, loan, or otherwise commercially exploit any STARFORGE Content in digital form; (c) include STARFORGE Content in any commercial product, bundle, collection, or offering of digital files; (d) create or operate any database, archive, repository, or collection of STARFORGE Content; (e) use any automated systems, including but not limited to robots, spiders, scrapers, crawlers, or similar technologies, to access, download, copy, or extract STARFORGE Content or any other content from the Services; (f) circumvent, disable, bypass, or interfere with any security, access control, rate limiting, or other protective features of the Services; (g) impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity; (h) interfere with or disrupt the Services, servers, networks, or infrastructure connected to the Services; (i) violate any applicable law, regulation, ordinance, or third-party right in connection with your use of the Services; or (j) engage in any conduct that STARFORGE determines, in its sole discretion, to be harmful to STARFORGE, its users, or the integrity of the Services.

5.2. Digital Redistribution Strictly Prohibited. For the avoidance of doubt and without limiting the generality of Section 5.1, the redistribution of STARFORGE Content in digital form is strictly and absolutely prohibited under all circumstances, regardless of whether such redistribution is: (a) commercial or non-commercial; (b) for profit or not for profit; (c) of original files or modified/ derivative versions; (d) complete files or partial excerpts; (e) through public platforms or private channels; (f) free of charge or for a fee; or (g) characterized as "sharing," "backup," "archival," or by any other designation. This prohibition applies to all users, regardless of membership tier, and violation of this prohibition constitutes grounds for immediate termination of access and may result in legal action.

6. Intellectual Property Rights

6.1. STARFORGE Ownership. STARFORGE and its licensors own all right, title, and interest in and to the Services and all STARFORGE Content, including but not limited to all 3D model files, designs, artwork, graphics, photographs, text, software, code, data, trademarks, service marks, trade dress, logos, and other intellectual property, and all intellectual property rights therein, including but not limited to copyrights, trademark rights, patent rights, trade secret rights, and all other proprietary rights recognized under any applicable law. Your use of the Services does not grant you any ownership rights in or to the Services or any STARFORGE Content, and all rights not expressly granted in these Terms are reserved by STARFORGE.

6.2. License to Use STARFORGE Content. Subject to your compliance with these Terms, STARFORGE grants you a limited, non-exclusive, non-transferable, revocable license to access, download (subject to applicable limitations), and use STARFORGE Content solely for: (a) personal, non-commercial use, including personal 3D printing and creation of Physical Products for personal use; and (b) if you are an active Merchant or Starforger tier subscriber, commercial use in accordance with the Commercial License terms set forth in Section 4. This license does not include any right to: (i) modify, adapt, translate, reverse engineer, decompile, or disassemble the Services or any software components thereof; (ii) create derivative works based on the Services (as distinguished from Physical Products created from STARFORGE Content); (iii) use the Services or STARFORGE Content for any unlawful purpose; or (iv) use the Services or STARFORGE Content in any manner that infringes, misappropriates, or violates any third-party rights.

6.3. Fan Art and Transformative Works. Certain STARFORGE Content may include designs that constitute fan art, parody, tribute, or transformative works inspired by or referencing characters, settings, or elements from popular media, entertainment properties, or cultural phenomena. Such works are created as original artistic expressions and are protected as fair use, parody, or transformative works under applicable law. STARFORGE makes no claim of ownership or affiliation with the original intellectual property holders of any referenced properties. If you are an intellectual property holder and have concerns regarding any content on the Services, please contact us through the contact form available on any product page to discuss your concerns.

6.4. Feedback and Suggestions. If you provide STARFORGE with any feedback, suggestions, ideas, recommendations, or other input regarding the Services or STARFORGE Content ("Feedback"), you hereby grant STARFORGE a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, transferable license to use, reproduce, modify, adapt, publish, distribute, display, perform, and create derivative works based on such Feedback for any purpose, without attribution, compensation, or other obligation to you.

7. User Conduct and Communications

7.1. Acceptable Use. You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for all activities that occur under your account and for ensuring that your use of the Services complies with all applicable laws and regulations.

7.2. User Communications. The Services may include functionality allowing you to submit feedback, comments, inquiries, or other communications through contact forms. You agree that any communications you submit: (a) shall be accurate, truthful, and not misleading; (b) shall not infringe, misappropriate, or violate any third-party intellectual property rights, privacy rights, publicity rights, or other rights; (c) shall not contain any material that is defamatory, libelous, obscene, pornographic, threatening, harassing, abusive, hateful, or otherwise objectionable; (d) shall not contain any viruses, malware, or other harmful code; and (e) shall not violate any applicable law or regulation. STARFORGE reserves the right to monitor, review, edit, remove, or refuse to post any User communications, in its sole discretion, without notice or liability.

8. Disclaimer of Warranties

8.1. "As Is" Basis. THE SERVICES AND ALL STARFORGE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STARFORGE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, COMPATIBILITY, SECURITY, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL CODE.

8.2. No Guarantee of Printability. STARFORGE DOES NOT WARRANT OR GUARANTEE THAT ANY 3D MODEL FILE OR OTHER STARFORGE CONTENT WILL PRINT SUCCESSFULLY, PRODUCE SATISFACTORY RESULTS, OR BE COMPATIBLE WITH YOUR 3D PRINTER, FILAMENT, SETTINGS, OR OTHER EQUIPMENT. 3D PRINTING INVOLVES NUMEROUS VARIABLES OUTSIDE OF STARFORGE'S CONTROL, INCLUDING BUT NOT LIMITED TO PRINTER HARDWARE, FIRMWARE, SOFTWARE, SLICER SETTINGS, FILAMENT QUALITY, ENVIRONMENTAL CONDITIONS, AND USER SKILL LEVEL. YOU ACKNOWLEDGE AND ACCEPT THAT YOU USE STARFORGE CONTENT FOR 3D PRINTING AT YOUR OWN RISK AND THAT STARFORGE IS NOT RESPONSIBLE FOR ANY FAILED PRINTS, WASTED MATERIALS, EQUIPMENT DAMAGE, OR OTHER LOSSES RESULTING FROM YOUR USE OF STARFORGE CONTENT.

8.3. No Professional Advice. The Services and STARFORGE Content are provided for informational and creative purposes only and do not constitute professional, legal, financial, engineering, or other specialized advice. You should not rely on the Services or STARFORGE Content as a substitute for professional advice appropriate to your specific circumstances.

9. Limitation of Liability

9.1. Exclusion of Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STARFORGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) ANY FAILED PRINTS, WASTED MATERIALS, OR EQUIPMENT ISSUES; OR (F) ANY OTHER MATTER RELATING TO THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF STARFORGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2. Cap on Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF STARFORGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO STARFORGE (THROUGH PATREON OR OTHERWISE) DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

9.3. Basis of the Bargain. YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY SET FORTH IN SECTIONS 8 AND 9 REFLECT A FAIR AND REASONABLE ALLOCATION OF RISKS AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND STARFORGE. STARFORGE WOULD NOT BE ABLE TO PROVIDE THE SERVICES TO YOU ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE LIMITATIONS.

10. Indemnification

10.1. Your Indemnification Obligations. You agree to indemnify, defend, and hold harmless STARFORGE, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Services; (b) your breach of these Terms or any representation or warranty contained herein; (c) your violation of any applicable law, regulation, or third-party right; (d) any User Content or communications you submit through the Services; (e) any Physical Products you create, manufacture, sell, or distribute using STARFORGE Content; and (f) any dispute between you and any third party relating to your use of the Services or STARFORGE Content.

11. Termination

11.1. Termination by STARFORGE. STARFORGE may, in its sole discretion, at any time and for any reason or no reason, with or without prior notice: (a) suspend or restrict your access to all or any part of the Services; (b) terminate your account and any licenses granted herein; (c) delete any of your data, User Content, or other information associated with your account; and (d) take any other action STARFORGE deems appropriate. Without limiting the foregoing, STARFORGE may terminate your access to the Services immediately and without notice if STARFORGE believes, in its sole discretion, that you have violated or acted inconsistently with any provision of these Terms.

11.2. Termination by You. You may terminate your use of the Services at any time by ceasing all use of the Services. To terminate a paid subscription, you must cancel your subscription through Patreon in accordance with Patreon's cancellation procedures.

11.3. Effect of Termination. Upon termination of your access to the Services for any reason: (a) all licenses and rights granted to you under these Terms shall immediately terminate; (b) you must immediately cease all use of the Services and STARFORGE Content; (c) if you hold a Commercial License, such license shall immediately terminate and you must cease all commercial activities involving STARFORGE Content; and (d) you shall have no further right to access your account or any Content or data associated therewith. Sections 2, 4.4, 4.5, 5, 6, 8, 9, 10, 12, 13, 14, and 15 shall survive termination of these Terms.

12. Hardship Policy

12.1. Acknowledgment of Financial Difficulties. STARFORGE acknowledges that users may occasionally experience financial hardship, unemployment, medical issues, or other circumstances that may affect their ability to maintain a paid subscription. While maintaining an active subscription is necessary for continued access to premium features and Commercial License rights, STARFORGE is committed to supporting its community of makers and creators.

12.2. Informal Accommodation. STARFORGE is a small, independent operation, not a large corporation with extensive legal departments. We believe in treating our community members with understanding and compassion. If you are experiencing financial hardship and wish to discuss your situation, you are encouraged to contact us through the contact form available on any product page. While we cannot guarantee any particular accommodation, we will endeavor to work with you in good faith to find a mutually acceptable solution where feasible. This Section 12 does not create any binding obligation on STARFORGE or any enforceable right for users, and any accommodations provided are at STARFORGE's sole discretion on a case-by-case basis.

13. Dispute Resolution

13.1. Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact STARFORGE through the contact form available on any product page and attempt to resolve any dispute informally. STARFORGE will attempt to resolve the dispute by contacting you through available means. If a dispute is not resolved within thirty (30) days of submission, either party may proceed with formal dispute resolution as provided herein.

13.2. Governing Law. These Terms and any dispute arising out of or relating to these Terms or your use of the Services shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles that would result in the application of the laws of a different jurisdiction.

14. General Provisions

14.1. Entire Agreement. These Terms, together with the Privacy Policy and any Additional Terms, constitute the entire agreement between you and STARFORGE with respect to your use of the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, regarding such subject matter.

14.2. Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein, provided that the remaining provisions continue to effectuate the parties' intent.
