Terms of Service

These Terms of Service ("Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you (hereinafter referred to as "User," "you," "your," "Member," or "Subscriber") and STARFORGE, operated through the website located at https://www.StarForgeKits.com (hereinafter referred to as "STARFORGE," "Company," "we," "us," or "our"), governing your access to and use of the StarForgeKits.com website, including all content, features, functionality, services, applications, and digital properties offered through or in connection therewith (collectively, the "Services"). Please read these Terms carefully before accessing or using the Services. By accessing, browsing, registering for, subscribing to, downloading from, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must immediately discontinue all use of the Services.

1. Acceptance of Terms

1.1. Agreement to Terms. By accessing or using the Services in any manner, including but not limited to visiting or browsing the website, registering for an account, subscribing to a membership tier, downloading files, or contributing content, you affirm that you are of legal age to enter into this Agreement, or if you are not, that you have obtained parental or guardian consent to enter into this Agreement and your parent or guardian consents to these Terms on your behalf. You further affirm that you have the legal capacity and authority to enter into a binding agreement, and that your use of the Services will comply with all applicable laws, regulations, and ordinances.

1.2. Modifications to Terms. STARFORGE reserves the right, in its sole and absolute discretion, to modify, amend, supplement, or replace these Terms at any time, for any reason, with or without prior notice. Any modifications shall be effective immediately upon posting of the revised Terms on the Services. Your continued access to or use of the Services following the posting of any modifications constitutes your binding acceptance of such modifications. It is your sole responsibility to review these Terms periodically for changes. If you do not agree to any modification of these Terms, your sole and exclusive remedy is to discontinue use of the Services.

1.3. Additional Terms. Certain features, services, or promotions made available through the Services may be subject to additional terms, conditions, policies, or guidelines ("Additional Terms"). In the event of a conflict between these Terms and any Additional Terms, the Additional Terms shall govern with respect to the specific feature, service, or promotion to which they apply, unless the Additional Terms expressly state otherwise.

2. Definitions and Interpretation

2.1. Definitions. For purposes of these Terms, the following definitions shall apply unless the context clearly requires otherwise: "Content" means all text, graphics, images, photographs, illustrations, designs, logos, trademarks, trade dress, icons, audio, video, software, code, data, 3D model files (including but not limited to STL, OBJ, and other file formats), documentation, and any other materials or information available on or through the Services, whether created by STARFORGE, Users, or third parties. "User Content" means any Content that Users submit, upload, post, transmit, or otherwise make available through the Services, including but not limited to comments, feedback, reviews, messages, and communications. "STARFORGE Content" means all Content that is owned by, created by, licensed to, or otherwise provided by STARFORGE, including but not limited to all 3D model files, designs, artwork, graphics, website design, text, and software. "Membership" means a subscription to any of the membership tiers described in Section 3.2, including the tier offered at no charge, held through any of the subscription platforms named in Section 3.1. "Commercial License" means the limited license granted to Members under Section 4 to sell physical prints derived from STARFORGE Content, subject to the terms and conditions set forth herein.

2.2. Interpretation. In these Terms: (a) headings and subheadings are for convenience of reference only and shall not affect the interpretation or construction of any provision; (b) words importing the singular include the plural and vice versa; (c) words importing a gender include all genders; (d) references to "including," "include," or "includes" shall be deemed to be followed by the phrase "without limitation" or "but not limited to"; (e) references to any statute, regulation, or law include any amendment, modification, supplement, re-enactment, or successor thereto; (f) references to "days" mean calendar days unless otherwise specified; and (g) references to "dollars" or "$" mean United States dollars.

3. Membership Tiers and Access Rights

3.1. Overview of Membership Tiers. STARFORGE offers the membership tiers set out in Section 3.2 below, each with its own price, monthly allowance, and licensing terms. Subscriptions are billed and administered through third-party platforms — Patreon and Stripe — and by subscribing you also agree to the terms of service and privacy policy of the platform through which you subscribe, in addition to these Terms. STARFORGE reserves the right to modify, add, remove, or restructure membership tiers at any time, in its sole discretion; the tiers described in Section 3.2 are those offered as of the date of these Terms.

3.2. Current Membership Tiers, Prices, and Monthly Allowances. The following tiers are available to new subscribers. The picks and randoms below are per-period allowances and reset onyour monthly renewal date, together with generation tokens; see Section 3.4.

3.2.1. Starter. The Starter tier is $9 per month (or $90 per year through Stripe, billed annually), and includes 2 files of your choosing, 4 random draws, and no generation tokens per month, renewing on your monthly renewal date. Subscribed through Patreon, the same tier is $10 per month, which includes that platform's own fee.

3.2.2. Merchant. The Merchant tier is $19 per month (or $190 per year through Stripe, billed annually), and includes 10 files of your choosing, 20 random draws, and 120 generation tokens per month, renewing on your monthly renewal date. Subscribed through Patreon, the same tier is $22 per month, which includes that platform's own fee.

3.2.3. Merchant+. The Merchant+ tier is $39 per month (or $390 per year through Stripe, billed annually), and includes 80 files of your choosing, 160 random draws, and 500 generation tokens per month, renewing on your monthly renewal date. Subscribed through Patreon, the same tier is $44 per month, which includes that platform's own fee.

3.2.4. AI. The AI tier is $99 per month (or $990 per year through Stripe, billed annually), and includes 200 files of your choosing, 400 random draws, and 5,000 generation tokens per month, renewing on your monthly renewal date. Subscribed through Patreon, the same tier is $110 per month, which includes that platform's own fee.

3.2.5. AI Max. The AI Max tier is $199 per month (or $1,990 per year through Stripe, billed annually), and includes 400 files of your choosing, 800 random draws, and 20,000 generation tokens per month, renewing on your monthly renewal date. Subscribed through Patreon, the same tier is $220 per month, which includes that platform's own fee.

3.2.1. Meaning of "period". Throughout these Terms, a "period" is the monthly interval running from your monthly renewal date to the same date in the following month.Everything resets on your own monthly renewal date -- the day of the month you signed up, or the last day of a shorter month -- not on the 1st. Where the day of the month on which you subscribed does not exist in a given month, the last day of that month is used, and the following month reverts to the original date. A period is one month long whether you are billed monthly or annually: an annual subscription is twelve monthly allowances bought together, not one annual allowance.

3.3. Unlocks, Re-Downloads, and Resets. A "pick" is a file you choose from the library. A "random" is a file drawn at random on your behalf. Choosing or drawing a file "unlocks" it and consumes one unit of the corresponding allowance. Once a file has been unlocked, you may download it again as many times as you wish for the remainder of that period, and doing so does not consume a further unit of any allowance. On your monthly renewal date every file you unlocked in the previous period is locked again, and your allowances reset. To obtain a previously unlocked file after that date you must unlock it again, which consumes a unit of the applicable allowance in the same way as any other file. A file you have already downloaded to your own device remains yours; the reset governs access through the Services only. Beyond the monthly allowance for NEW unlocks, STARFORGE does not meter how often you download a file you have already unlocked. STARFORGE does apply technical rate limits to requests for signing in, sending us a message, starting or changing a subscription, recovering interrupted generations, chatting with our print expert, buying a token pack, deleting your account, and generating images and 3D models, in order to prevent abuse of the Services; those limits are an anti-abuse measure and are not a limit on how much of your allowance you may use. STARFORGE does not rate-limit downloads. No allowance accumulates: any part of a period's picks, randoms or generation tokens that is not used within that period is not carried forward and has no value thereafter.

3.4. Generation Tokens. Certain tiers include a periodic grant of tokens, which are consumed by the generative tools offered on the Services. Producing an image, whether from text or by transforming an image you supply, consumes 2 tokens. Producing a 3D model that STARFORGE retains consumes 50 tokens. Producing a 3D model that you mark as private consumes 200 tokens. Tokens granted as part of a subscription are available for so long as that subscription remains active and cease to be available when it ends; tokens bought outright are treated differently, as set out below. Any generation tokens unused at the end of a period cease to exist and have no value thereafter, and are not carried forward. Where a generation fails, the tokens it consumed are returned to your balance: automatically for an image, and on request for a 3D model, by contacting us by email at mineeform@gmail.com. Tokens are not returned where you withdraw a 3D model from the queue yourself, that being a decision of yours rather than a failure of the Services.

3.6. Subscription Management. Your payment is processed by the platform through which you subscribed, and STARFORGE neither stores nor handles payment card details. STARFORGE is able to cancel a subscription billed through Stripe on your behalf; it is not able to cancel a subscription billed through Patreon, as that platform permits only the subscriber to cancel a pledge. STARFORGE is not responsible for errors, delays, or issues arising from a payment platform's own processing or subscription management systems.

3.7. Changing Your Tier. You may move between the tiers in Section 3.2 at any time. For a subscription billed through Stripe, STARFORGE presents the change for your confirmation on that platform's own secure page; no change takes effect until you confirm it there. An upgrade takes effect immediately and that platform charges the difference for the remainder of the current billing period on a pro-rata basis. A downgrade takes effect at the end of the current billing period, and you continue to be billed at your existing rate until then. Allowances are separate from billing. On a change of tier, your allowance for the current period becomes the new tier's allowance less whatever you have already used that month, and is never less than nothing. All allowances reset on the first day of each period on your monthly renewal date, regardless of when you changed tier. A subscription billed through Patreon must be changed on that platform directly.

4. Commercial License Terms and Conditions

4.1. Grant of Commercial License. Subject to the terms and conditions of this Agreement, STARFORGE grants to every Member, at every membership tier offered under Section 3.2 and including the tier offered at no charge, a limited, non-exclusive, non-transferable, revocable license (the "Commercial License") to create, manufacture, produce, and sell physical prints, reproductions, and tangible objects derived from or incorporating STARFORGE Content (collectively, "Physical Products"). The Commercial License permits the commercial sale of Physical Products through any sales channel, platform, marketplace, or venue, whether online or offline, including but not limited to personal websites, e-commerce platforms (such as Etsy, eBay, Amazon, and similar marketplaces), craft fairs, conventions, and retail establishments.

4.1.1. What the Grant Covers, and For How Long. The grant made in Section 4.1 extends only to STARFORGE Content that the Member unlocked during the then-current period, and only for the duration of that period. At the end of a period, the right to sell Physical Products made from the Content unlocked during it comes to an end, and the Content unlocked during the next period is covered in its place.

4.1.2. What Does Not End. For the avoidance of doubt, and notwithstanding Section 4.1.1: a file that a Member has already downloaded remains that Member's to keep and to print for their own personal, non-commercial use, permanently, and STARFORGE will not require its deletion. What comes to an end at the close of a period is the right to SELL Physical Products made from that Content, and nothing else.

4.2. Scope and Limitations. The Commercial License granted herein is subject to the following limitations, restrictions, and conditions: (a) the Commercial License applies exclusively to the sale of Physical Products—tangible, physical objects that have been manufactured, printed, or otherwise produced from STARFORGE Content; (b) the Commercial License does not authorize, and expressly prohibits, the sale, distribution, licensing, sublicensing, transfer, or other disposition of STARFORGE Content in digital form, including but not limited to STL files, OBJ files, source files, or any other digital representations of STARFORGE Content, whether in original, modified, derivative, or any other form; (c) the Commercial License does not authorize the sublicensing, assignment, or transfer of any rights to third parties; (d) the Commercial License does not authorize the use of STARFORGE trademarks, trade names, logos, or other brand identifiers in a manner that suggests endorsement, sponsorship, or affiliation with STARFORGE, unless expressly authorized in writing; and (e) the Commercial License is personal to the subscribing Member and may not be shared with, used by, or transferred to any other person, entity, or business.

4.3. Modification of Files. Members are permitted to modify, adapt, scale, cut, combine, remix, or otherwise alter STARFORGE Content for their personal use or for the purpose of creating Physical Products for sale under the Commercial License. However, such modifications do not create any ownership rights in the underlying STARFORGE Content, and the restrictions on digital distribution apply equally to modified, derivative, or adapted versions of STARFORGE Content. Under no circumstances may modified, derivative, or adapted versions of STARFORGE Content be distributed, shared, sold, or otherwise made available in digital form.

4.4. Termination of Commercial License. The Commercial License shall automatically and immediately terminate, without notice or further action, upon the earliest of: (a) the close of the calendar month in which the Content was unlocked, as provided in Section 4.1.1; (b) cancellation, termination, or expiration of the Member's subscription, at whichever tier it is held; (c) failure to pay subscription fees when due, resulting in lapse of membership; (d) breach of any term or condition of this Agreement; (e) termination of the Member's account for any reason; or (f) termination of the Services. Where the Commercial License terminates under clause (a), what ends is the right to sell Physical Products made from the Content unlocked in that period, and nothing else; the Member's subscription, their other rights under these Terms, and the Commercial License covering the Content they unlock in the next period are unaffected. Where it terminates under clauses (b) to (f), the former Member shall immediately cease all commercial activities involving STARFORGE Content, including the sale of any remaining inventory of Physical Products. In either case STARFORGE reserves the right, in its sole discretion, to grant reasonable wind-down periods for existing inventory in cases of non-fault termination.

4.5. No Retroactive Rights. Termination of the Commercial License does not create retroactive liability for Physical Products lawfully sold during the period when the Commercial License was in effect. However, any Physical Products sold after termination of the Commercial License shall constitute a breach of this Agreement and infringement of STARFORGE's intellectual property rights.

5. Prohibited Conduct and Restrictions

5.1. General Prohibitions. In connection with your access to and use of the Services, you agree that you shall not, directly or indirectly, and shall not authorize, permit, enable, or assist any third party to: (a) redistribute, share, upload, publish, post, transmit, stream, broadcast, or otherwise make available any STARFORGE Content in digital form to any third party, through any medium, channel, platform, or method, whether for commercial or non-commercial purposes; (b) sell, license, sublicense, rent, lease, loan, or otherwise commercially exploit any STARFORGE Content in digital form; (c) include STARFORGE Content in any commercial product, bundle, collection, or offering of digital files; (d) create or operate any database, archive, repository, or collection of STARFORGE Content; (e) use any automated systems, including but not limited to robots, spiders, scrapers, crawlers, or similar technologies, to access, download, copy, or extract STARFORGE Content or any other content from the Services; (f) circumvent, disable, bypass, or interfere with any security, access control, rate limiting, or other protective features of the Services; (g) impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity; (h) interfere with or disrupt the Services, servers, networks, or infrastructure connected to the Services; (i) violate any applicable law, regulation, ordinance, or third-party right in connection with your use of the Services; or (j) engage in any conduct that STARFORGE determines, in its sole discretion, to be harmful to STARFORGE, its users, or the integrity of the Services.

5.2. Digital Redistribution Strictly Prohibited. For the avoidance of doubt and without limiting the generality of Section 5.1, the redistribution of STARFORGE Content in digital form is strictly and absolutely prohibited under all circumstances, regardless of whether such redistribution is: (a) commercial or non-commercial; (b) for profit or not for profit; (c) of original files or modified/ derivative versions; (d) complete files or partial excerpts; (e) through public platforms or private channels; (f) free of charge or for a fee; or (g) characterized as "sharing," "backup," "archival," or by any other designation. This prohibition applies to all users, regardless of membership tier, and violation of this prohibition constitutes grounds for immediate termination of access and may result in legal action.

6. Intellectual Property Rights

6.1. STARFORGE Ownership. STARFORGE and its licensors own all right, title, and interest in and to the Services and all STARFORGE Content, including but not limited to all 3D model files, designs, artwork, graphics, photographs, text, software, code, data, trademarks, service marks, trade dress, logos, and other intellectual property, and all intellectual property rights therein, including but not limited to copyrights, trademark rights, patent rights, trade secret rights, and all other proprietary rights recognized under any applicable law. Your use of the Services does not grant you any ownership rights in or to the Services or any STARFORGE Content, and all rights not expressly granted in these Terms are reserved by STARFORGE.

6.2. License to Use STARFORGE Content. Subject to your compliance with these Terms, STARFORGE grants you a limited, non-exclusive, non-transferable, revocable license to access, download (subject to applicable limitations), and use STARFORGE Content solely for: (a) personal, non-commercial use, including personal 3D printing and creation of Physical Products for personal use; and (b) commercial use of STARFORGE Content on the terms set out in Section 4, which is limited to Content unlocked during the current period. The right granted under (a) is revocable only as to Content you have not yet downloaded: once a file is on your device, Section 4.1.2 governs it and that right is permanent. The right granted under (b) is revocable on the terms set out in Sections 4.4 and 11.3. This license does not include any right to: (i) modify, adapt, translate, reverse engineer, decompile, or disassemble the Services or any software components thereof; (ii) create derivative works based on the Services (as distinguished from Physical Products created from STARFORGE Content); (iii) use the Services or STARFORGE Content for any unlawful purpose; or (iv) use the Services or STARFORGE Content in any manner that infringes, misappropriates, or violates any third-party rights.

6.3. Fan Art and Transformative Works. Certain STARFORGE Content may include designs that constitute fan art, parody, tribute, or transformative works inspired by or referencing characters, settings, or elements from popular media, entertainment properties, or cultural phenomena. Such works are created as original artistic expressions and are protected as fair use, parody, or transformative works under applicable law. STARFORGE makes no claim of ownership or affiliation with the original intellectual property holders of any referenced properties. If you are an intellectual property holder and have concerns regarding any content on the Services, please contact us by email at mineeform@gmail.com to discuss your concerns.

6.4. Feedback and Suggestions. If you provide STARFORGE with any feedback, suggestions, ideas, recommendations, or other input regarding the Services or STARFORGE Content ("Feedback"), you hereby grant STARFORGE a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, transferable license to use, reproduce, modify, adapt, publish, distribute, display, perform, and create derivative works based on such Feedback for any purpose, without attribution, compensation, or other obligation to you.

7. User Conduct and Communications

7.1. Acceptable Use. You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for all activities that occur under your account and for ensuring that your use of the Services complies with all applicable laws and regulations.

7.2. User Communications. The Services may include functionality allowing you to submit feedback, comments, inquiries, or other communications by email. You agree that any communications you submit: (a) shall be accurate, truthful, and not misleading; (b) shall not infringe, misappropriate, or violate any third-party intellectual property rights, privacy rights, publicity rights, or other rights; (c) shall not contain any material that is defamatory, libelous, obscene, pornographic, threatening, harassing, abusive, hateful, or otherwise objectionable; (d) shall not contain any viruses, malware, or other harmful code; and (e) shall not violate any applicable law or regulation. STARFORGE reserves the right to monitor, review, edit, remove, or refuse to post any User communications, in its sole discretion, without notice or liability.

8. Disclaimer of Warranties

8.1. "As Is" Basis. THE SERVICES AND ALL STARFORGE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STARFORGE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, COMPATIBILITY, SECURITY, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL CODE.

8.2. No Guarantee of Printability. STARFORGE DOES NOT WARRANT OR GUARANTEE THAT ANY 3D MODEL FILE OR OTHER STARFORGE CONTENT WILL PRINT SUCCESSFULLY, PRODUCE SATISFACTORY RESULTS, OR BE COMPATIBLE WITH YOUR 3D PRINTER, FILAMENT, SETTINGS, OR OTHER EQUIPMENT. 3D PRINTING INVOLVES NUMEROUS VARIABLES OUTSIDE OF STARFORGE'S CONTROL, INCLUDING BUT NOT LIMITED TO PRINTER HARDWARE, FIRMWARE, SOFTWARE, SLICER SETTINGS, FILAMENT QUALITY, ENVIRONMENTAL CONDITIONS, AND USER SKILL LEVEL. YOU ACKNOWLEDGE AND ACCEPT THAT YOU USE STARFORGE CONTENT FOR 3D PRINTING AT YOUR OWN RISK AND THAT STARFORGE IS NOT RESPONSIBLE FOR ANY FAILED PRINTS, WASTED MATERIALS, EQUIPMENT DAMAGE, OR OTHER LOSSES RESULTING FROM YOUR USE OF STARFORGE CONTENT.

8.3. No Professional Advice. The Services and STARFORGE Content are provided for informational and creative purposes only and do not constitute professional, legal, financial, engineering, or other specialized advice. You should not rely on the Services or STARFORGE Content as a substitute for professional advice appropriate to your specific circumstances.

9. Limitation of Liability

9.1. Exclusion of Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STARFORGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) ANY FAILED PRINTS, WASTED MATERIALS, OR EQUIPMENT ISSUES; OR (F) ANY OTHER MATTER RELATING TO THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF STARFORGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2. Cap on Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF STARFORGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO STARFORGE (THROUGH ANY PLATFORM NAMED IN SECTION 3.1) DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

9.3. Basis of the Bargain. YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY SET FORTH IN SECTIONS 8 AND 9 REFLECT A FAIR AND REASONABLE ALLOCATION OF RISKS AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND STARFORGE. STARFORGE WOULD NOT BE ABLE TO PROVIDE THE SERVICES TO YOU ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE LIMITATIONS.

10. Indemnification

10.1. Your Indemnification Obligations. You agree to indemnify, defend, and hold harmless STARFORGE, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Services; (b) your breach of these Terms or any representation or warranty contained herein; (c) your violation of any applicable law, regulation, or third-party right; (d) any User Content or communications you submit through the Services; (e) any Physical Products you create, manufacture, sell, or distribute using STARFORGE Content; and (f) any dispute between you and any third party relating to your use of the Services or STARFORGE Content.

11. Termination

11.1. Termination by STARFORGE. STARFORGE may, in its sole discretion, at any time and for any reason or no reason, with or without prior notice: (a) suspend or restrict your access to all or any part of the Services; (b) terminate your account and any licenses granted herein; (c) delete any of your data, User Content, or other information associated with your account; and (d) take any other action STARFORGE deems appropriate. Without limiting the foregoing, STARFORGE may terminate your access to the Services immediately and without notice if STARFORGE believes, in its sole discretion, that you have violated or acted inconsistently with any provision of these Terms.

11.2. Termination by You. You may terminate your use of the Services at any time by ceasing all use of the Services. To terminate a paid subscription, cancel it as described in Section 3.6.

11.3. Effect of Termination. This Section is subject to Sections 4.1.2 and 4.4, which survive it: a file you have already downloaded remains yours to keep and to print for personal use permanently. Subject to those, upon termination of your access to the Services for any reason: (a) all licenses and rights granted to you under these Terms shall immediately terminate; (b) you must immediately cease all use of the Services and STARFORGE Content; (c) any Commercial License you hold shall immediately terminate and you must cease all commercial activities involving STARFORGE Content; and (d) you shall have no further right to access your account or any Content or data associated therewith held on the Services. Sections 2, 4.1, 4.1.1, 4.1.2, 4.2, 4.3, 4.4, 4.5, 5, 6, 8, 9, 10, 12, 13, 14, and 15 shall survive termination of these Terms.

12. Hardship Policy

12.1. Acknowledgment of Financial Difficulties. STARFORGE acknowledges that users may occasionally experience financial hardship, unemployment, medical issues, or other circumstances that may affect their ability to maintain a paid subscription. Access to premium features requires an active subscription; the Commercial License is governed by Section 4 and is not affected by this Section. STARFORGE is committed to supporting its community of makers and creators.

12.2. Informal Accommodation. STARFORGE is a small, independent operation, not a large corporation with extensive legal departments. We believe in treating our community members with understanding and compassion. If you are experiencing financial hardship and wish to discuss your situation, you are encouraged to contact us by email at mineeform@gmail.com. While we cannot guarantee any particular accommodation, we will endeavor to work with you in good faith to find a mutually acceptable solution where feasible. This Section 12 does not create any binding obligation on STARFORGE or any enforceable right for users, and any accommodations provided are at STARFORGE's sole discretion on a case-by-case basis.

13. Dispute Resolution

13.1. Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact STARFORGE by email at mineeform@gmail.com and attempt to resolve any dispute informally. STARFORGE will attempt to resolve the dispute by contacting you through available means. If a dispute is not resolved within thirty (30) days of submission, either party may proceed with formal dispute resolution as provided herein.

13.2. Governing Law. These Terms and any dispute arising out of or relating to these Terms or your use of the Services shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles that would result in the application of the laws of a different jurisdiction.

14. General Provisions

14.1. Entire Agreement. These Terms, together with the Privacy Policy and any Additional Terms, constitute the entire agreement between you and STARFORGE with respect to your use of the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, regarding such subject matter.

14.2. Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein, provided that the remaining provisions continue to effectuate the parties' intent.

14.3. Waiver. The failure of STARFORGE to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by an authorized representative of STARFORGE.

14.4. Assignment. You may not assign, transfer, or delegate these Terms or any of your rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of STARFORGE. STARFORGE may assign, transfer, or delegate these Terms or any rights or obligations hereunder without restriction. Any purported assignment in violation of this Section shall be null and void.

14.5. No Third-Party Beneficiaries. These Terms are for the sole benefit of STARFORGE and you, and nothing in these Terms shall be deemed to confer any rights or benefits on any third party.

14.6. Force Majeure. STARFORGE shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
